GENERAL INFORMATION
The purpose of these general terms and conditions of sale (GTC) is to inform any potential customer of the conditions and terms under which the seller proceeds with the sale of products from the catalog posted online on the website bleudepaname.com . The GTC establish the rights and obligations of the parties in the context of the sale.
Validation of the order by the customer implies acceptance by the buyer of these general conditions of sale without reservation.
If one of the clauses of these general conditions of sale were to be null or void, the other clauses would not be nullified.
The fact that the seller does not apply at any given time any article of these conditions cannot be interpreted as a waiver of the right to subsequently invoke the said general conditions of sale.
ORDER
Any online order implies acceptance of these conditions.
AVAILABILITY
All orders are subject to acceptance and availability, and items in your cart are not reserved and may be purchased by other customers.
bleudepaname.com offers for sale products in stock and available for shipment. Sometimes, however, we may also receive simultaneous orders which may result in items being unavailable.
In these circumstances, you will be notified by our customer service as soon as possible.
bleudepaname.com reserves the right to restrict multiple quantities of an item shipped to a customer or postal address.
PRICE
The prices and VAT rates are those in effect on the day of the order.
They include packaging and delivery in mainland France, possibly increased by the price of the special terms chosen by the buyer.
Deliveries outside Metropolitan France and Corsica are subject to special conditions of which the customer will be informed before confirming their order.
All prices are given subject to obvious typographical error. If an error should occur, the seller will contact the customer to inform him of the error made by his services and will inform him that the order will be invoiced under the corrected conditions.
However, the customer has the right to refuse the price correction and will be free to cancel the corrected order without penalties.
DELIVERY
The delivery time is explicitly stated on the product sheet. This time limit is understood to exclude weekends and public holidays, and subject to availability of the products confirmed by the supplier. Any delay in delivery due to circumstances beyond the control of the seller will not result in the cancellation of the order. The seller cannot be held liable for any damage resulting from this delay.
However, if the delivery of the goods has not taken place 30 days after the indicative delivery date, for any reason other than a case of force majeure, the sale will then be cancelled and the buyer will be reimbursed without being able to claim any compensation.
The seller is automatically released from any liability in the event of force majeure or events such as: lockout, strike, epidemic, war, requisition, fire, flood, equipment accident, delay in transport or any other cause leading to partial or total unemployment for the seller or its suppliers.
The Seller shall inform the Buyer in a timely manner of the cases and events listed above.
Any delay in delivery due to an event characteristic of force majeure will result, at the seller's choice, either in the pure and simple resolution of the sale, or in the extension of delivery or availability times, without either party being able to claim any other compensation.
In any event, delivery on time can only take place if the buyer has fulfilled all of his obligations towards the seller.
When delivery is made by making available, the seller undertakes to inform the buyer in writing of the date of making available. The buyer undertakes to take delivery of the goods within 5 days of receipt of the notice of making available. After this period, the storage costs will be invoiced to the buyer without prejudice to any action that the seller may intend to take.

bleudepaname.com undertakes to make the products ordered available to the carrier within a maximum of 72 hours.
Orders placed on Friday after 2pm will be shipped the following Monday.
If the order is shipped to a country outside Metropolitan France and the European Union, you are the importer of the products concerned. In this case, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes may be payable to the carrier upon delivery of your order. These duties and sums do not concern the jurisdiction of bleudepaname.com . They will be the responsibility of the customer and are their sole responsibility both in terms of declarations and payments to the competent authorities for your country.
CLICK & COLLECT
For each order placed in "click & collect" you will receive an order confirmation email as well as an email stating that your order is ready to be collected. Without this last email, the stores will not be able to give you your order.
The store will welcome you to collect your order from Monday to Friday from 2:00 p.m. to 6:00 p.m.
TRANSPORTATION
The mode of transport chosen by the seller is contractually considered to be the most suitable for the delivery of the goods shipped. Any discrepancy in this regard must be the subject of an express request from the buyer.
It is the customer's responsibility to check the number and condition of the goods delivered upon receipt of delivery.
In the event of damage or deterioration, the buyer must make the usual reservations on the delivery note and inform the carrier within 48 hours of receipt, by registered letter with acknowledgment of receipt.
Please note that as shipping costs do not adapt to the number of pieces in your order, the seller reserves the right to charge additional costs if necessary.
RECEPTION & CONTROL
The inspection of the delivered goods must take place within 14 days following delivery.
Without prejudice to the arrangements to be made with respect to the carrier, the buyer must inform the seller by registered letter with acknowledgment of receipt within the period set above of any apparent defects or lack of conformity of the goods delivered.
If the buyer expressly or tacitly waives this receipt, the goods will be deemed delivered in accordance with the order.
The seller will replace as soon as possible and at its own expense, the products delivered whose apparent defects or lack of conformity have been duly proven by the customer.
Packages with removed warranty strips must be refused upon delivery. Please make reservations upon delivery if you have any doubts about the condition of the package and provide the following information within D+1 after delivery: photos of the goods, the damage, the packaging box, the transport label.
BACK
The buyer has 14 days from the date of receipt to notify us of their return request. Damaged or incomplete items will not be accepted and will be returned to you as is, at the buyer's expense. Please contact us using the contact form before returning a product or make the request directly on your customer account. Any return of an order without notifying our teams cannot be processed. The return is the responsibility of the customer. All returns must be made by a carrier that offers delivery against signature. If the return is sent by the customer to a mailbox or relay point, or without a signature, we cannot be held responsible for its proper delivery. If the package is refused by the customer, additional costs will be debited from the amount of the return.
Refunds are made to the payment method used by the customer within a maximum of 72 hours after receipt and inspection of the return.

Payment can be made in the following ways:

PENALTY CLAUSE
In accordance with Article L441-6 of the French Commercial Code, late payment penalties are applicable in the event that the amounts due are paid after the payment date appearing on the invoice.
These late payment penalties are calculated on the basis of (for example) 4 times the legal rate and will give rise to a minimum flat-rate charge of €100.
If the buyer's failure to act makes contentious recovery necessary, the buyer undertakes to pay, in addition to the principal, costs, expenses and emoluments ordinarily and legally payable by him, compensation set at 15% of the principal amount including tax of the debt with a minimum of 300 euros, as conventional and fixed damages.
In the event of termination of the sale for non-payment, the sums paid by the buyer will be purely and simply acquired by the seller.
EXTENDED WARRANTY
The products benefit from the legal guarantee of conformity under articles L211-4 of the Consumer Code. The products benefit from the legal guarantee against hidden defects arising from a defect in the material, design or manufacturing affecting the products and making them unfit for use, under articles 1641 et seq. of the Civil Code. The products benefit from the guarantees provided by the manufacturers of the products, according to the latter's forecasts.
In order to assert his rights, the customer must, under penalty of forfeiture of any action relating thereto, inform the seller of the existence of the defects, by registered letter with acknowledgment of receipt within the time limits provided for in Articles L211-12 of the Consumer Code and Article 1648 of the Civil Code.
WARRANTY EXCLUSION
The buyer will lose the benefit of legal and conventional guarantees, particularly in the event of:
abnormal or abusive use of the goods; repairs or any interventions carried out by persons other than the seller or not approved by him or by the manufacturer, or if these interventions have not followed the instructions; The seller may suspend the legal and conventional guarantees in the event of delay or non-payment, in whole or in part, of the price of the goods.
LIMITED WARRANTY
The seller's liability is limited to the repair or replacement of goods recognized as defective or with a manufacturing, labeling or packaging defect. The seller's services will have the possibility of searching for the alleged defects. All other express or implied guarantees are excluded. No liability will be accepted for losses or damages, direct or indirect, whatever the cause. Under no circumstances may the buyer claim, for any reason whatsoever, to make any deduction from the amount of invoices corresponding to an incomplete delivery or relating to defective goods.
APPLICABLE LAW AND JURISDICTION
This contract is subject to French law.
For all disputes relating to the execution or interpretation of these conditions, only the Commercial Court of Paris (France) or its president shall have jurisdiction in summary proceedings, even in the event of multiple defendants.
PROTECTION OF PERSONAL DATA
In accordance with Law No. 78-17 of January 6, 1978 "information technology and freedoms", the customer is informed that the responses to the various questionnaires are necessary for processing their registration and creating their personal space.
The information thus collected as well as that collected subsequently through the use of bleudepaname.com remains confidential and will be subject to automated processing.
The customer has the right to access, modify, rectify and delete information concerning him/her with customer service by contacting him/her directly via the contact form .
